Supreme Court of India has ordered the Central Government to make sure that women officers are given permanent commission in Indian Army. SC also said that women officers will be eligible for command posting and that permanent commission will apply to all serving women officer in Army , irrespective of their years of service.
The Supreme Court cleared that the terms of appointment of women officers shall be same as their male counterparts in Indian Army. Supreme Court rejected government’s opposition to permanent commission to women officers in Army citing physiological features and social mindset. SC called it ” gender stereotypes”.
Delivering a verdict on appeal against Delhi High Court’s direction, the Supreme Court on Monday said that it is insult to women as well as to army when aspersions are cast on women , their ability and their achievements in Army. The Supreme Court directed the government to implement policy decisions to grant permanent commission to women in the Army in the next three months.
Bench of Justices YV Chandrachud and Hemant Gupta upheld the High Court judgment (2010), which which says that women officers in short service commission (if found eligible) shoal be granted permanent commission in Army.
